Chess67 Terms of Service

1. Acceptance of Terms
By accessing or using Chess67.com and any related services (collectively, “Chess67,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not access or use the services.
If you are using Chess67 on behalf of a child, organization, or other entity, you represent and warrant that you have the legal authority to bind that party to these Terms.
2. Platform Role and Marketplace Disclaimer
Chess67 is an online platform that connects users, including players, parents, coaches, instructors, club organizers, and other third parties. Chess67 does not provide chess instruction, coaching, club supervision, childcare, or in-person events.
All lessons, memberships, events, products, and services are offered and provided solely by third-party sellers. Sellers are independent contractors and are not employees, agents, or representatives of Chess67.
Chess67 is not the seller, merchant of record, or service provider for transactions conducted on the platform and makes no representations regarding the quality, safety, legality, or suitability of any goods or services offered by users.
3. Community Guidelines and Acceptable Use
Chess67 is committed to maintaining a welcoming, safe, and reliable environment. The following conduct is prohibited:
- Hate speech, bullying, harassment, or threats of any kind
- Discrimination based on race, ethnicity, gender, sexual orientation, religion, disability, or similar characteristics
- Fraud, scams, impersonation, or deceptive practices
- Sharing sexually explicit, violent, or illegal content
- Violations of applicable laws or regulations
- Use of bots, scripts, scrapers, crawlers, automation tools, or similar technologies to access, scrape, collect, harvest, copy, or monitor any portion of the platform or its data without prior written consent from Chess67
- Attempting to bypass rate limits, access controls, authentication systems, or security measures
Chess67 reserves the right, at its sole discretion, to remove content, suspend accounts, terminate access, block IP addresses, or take other enforcement actions without notice for violations of these Terms.
4. Accounts, Minors, and Parental Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must be at least 18 years old to create an account or make purchases on Chess67. Parents or legal guardians may create accounts on behalf of children. In such cases:
- The parent or guardian is the account holder and contracting party
- The parent or guardian is fully responsible for the child’s activity and conduct
- The parent or guardian represents that they have provided any legally required consent for data collection and use
Chess67 does not independently verify ages, parental relationships, or supervision arrangements.
5. Purchases, Payments, and Refunds
Platform Fees
Chess67 may charge application fees, platform fees, or service fees in connection with transactions. These fees are non-refundable, except as required by law.
Third-Party Transactions
When you purchase a lesson, membership, event, or product, you are transacting directly with the seller. Sellers are responsible for fulfilling services, setting refund and cancellation policies, and complying with applicable laws.
Chess67 uses third-party payment processors, including Stripe. Payment processing is subject to the processor’s terms and policies.
Sellers are responsible for determining, collecting, reporting, and remitting any applicable taxes, duties, or similar governmental charges related to their offerings. Sellers must maintain accurate product tax classifications and fulfillment settings. Chess67 provides payment tooling only and does not provide tax or legal advice.
Refunds
Chess67 does not issue refunds for platform or application fees. Sellers may issue refunds for amounts they receive according to their stated policies.
Coach Non-Circumvention
If you are a coach, you may not solicit, direct, or encourage users who initially discovered you on Chess67 to purchase lessons off-platform. Lessons for those users must be purchased through Chess67.
6. Assumption of Risk and In-Person Activities
Some services offered through Chess67 may involve in-person instruction, events, or interactions, including activities involving minors.
You acknowledge and agree that:
- Participation in chess lessons, events, or related activities involves inherent risks, including physical injury, illness, or property loss
- Chess67 does not supervise, monitor, or control in-person activities
- Chess67 may offer optional coach background verification through third-party providers (for example, Checkr) or manual review flows when explicitly stated
You voluntarily assume all risks associated with participation and agree that Chess67 is not responsible for injuries, damages, or losses arising from in-person or offline interactions.
7. Disclaimer of Warranties
Chess67 is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Chess67 does not warrant that the services will be uninterrupted, error-free, secure, or free of harmful components.
8. Limitation of Liability
To the maximum extent permitted by law:
- Chess67 shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, data loss, personal injury, or emotional distress
- Chess67’s total liability for any claim shall not exceed the greater of (a) the amount you paid to Chess67 in the twelve months preceding the claim or (b) $100
Some jurisdictions do not allow certain limitations. In such cases, liability will be limited to the fullest extent permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless Chess67, its owners, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising out of:
- Your use of the platform
- Your interactions with other users
- Your violation of these Terms or applicable laws
- Any content you submit or services you provide
10. Intellectual Property
All Chess67 software, design, branding, logos, and platform content are owned by Chess67 or its licensors and are protected by intellectual property laws.
You retain ownership of content you submit but grant Chess67 a non-exclusive, worldwide, royalty-free license to host, display, distribute, reproduce, and use such content in connection with operating and promoting the platform.
11. Termination
Chess67 may suspend or terminate your account at any time, with or without notice, for any reason, including violations of these Terms, suspected fraud, or risk to the platform or other users.
Termination does not relieve you of obligations incurred prior to termination.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
Any dispute arising from these Terms or your use of Chess67 shall be brought exclusively in state or federal courts located in Georgia, and you consent to their jurisdiction and venue.
13. Changes to These Terms
Chess67 may modify these Terms at any time. Continued use of the services after changes become effective constitutes acceptance of the revised Terms.
